Terms of Use

The terms and conditions of use (hereinafter referred to as "Terms of Use") apply to the Audi Shop Website located at https://www.myaudi.tw/ (hereinafter referred to as "Website"). The Website is the property of Volkswagen Group Taiwan Co. Ltd., (hereinafter referred to as "Company") and its licensors. By using the Website, you agree to the Terms of Use. If you do not agree, please do not use the Website.

The Company reserves the right to change, modify, add or remove any part of the Terms of Use at any time in its sole discretion. It is your sole responsibility to periodically review the Terms of Use for changes. By continuing to use the Website after the changes are announced, you accept and agree to these changes. Under the premise that you comply with the Terms of Use, the Company grants you a personal, non-exclusive, non-transferable, limited right to access and use the Website.

The Company reserves the right to deny you access to the Website, services or allow you to create an account for any reason.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, site structure, site screen layout, web design and computer code (collectively referred to as "Content"), including but not limited to the design, structure, selection, coordination, presentation, "visual experience" and configuration of such Content, are owned, controlled or licensed by (or to) the Company and are protected by copyright, patent, trademark and trade secret laws, and various other intellectual property and competition laws.

You may use information related to Audi products and services (such as information sheets, knowledge base articles and similar materials) that the Company makes available for download on the Website, provided that you: (1) do not remove the text of proprietary notices from all copies of such documents; (2) use such information solely for your personal, non-commercial information purposes and do not copy or post such information to any network computer or broadcast it in any media; (3) make no changes to such information; and (4) make no additional representations or warranties with respect to such documents.

The trademarks and service marks of the Website, product and service names ( hereinafter referred to as "Trademark Information") are the property of Volkswagen Group Taiwan Co. Ltd., and its affiliates, and you may not display, use or otherwise deal with, or represent that you have the right to display, use or otherwise deal with the Trademark Information of Volkswagen Group Taiwan Co. Ltd., and its affiliates in any manner whatsoever without the prior written consent of Volkswagen Group Taiwan Co. Ltd., and its affiliates. 

You may not use any automatic device, program, algorithm or methodology, or similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or the Content, or to reproduce or circumvent in any way the navigational structure or layout of the Website or any Content, in order to obtain or purport to obtain any material, document or information through any means not permitted by the Website. The Company reserves the right to prohibit such conduct.

You may not attempt to gain unauthorized access to any part or function of the Website, any part or function of any other websites or networks linked to the system or any of the Company’s servers, or any services provided by or through the Website, whether by hacking, password mining, or any other illegal means.

You may not probe, scan or test the vulnerability of the Website or networks connected to the Website, or breach the security or authentication measures of the Website or networks connected to the Website; you may not reverse engineer, trace or attempt to trace information about any other users of or visitors to the Website, or any other customers of the Company (including any Audi Shop account that is not owned by you) to obtain its source, or use the Website, or any services or information provided on or through the Website (including but not limited to personally identifiable information of others provided on the Website) for the purpose of disclosing any information.

You agree not to take any action that would result in an unreasonable or disproportionately large load on the Website, the Company’s systems or networks, or the infrastructure of any systems or networks connected to the Website or to the Company.

You agree not to use any device, software or application that interferes or attempts to interfere with the proper functioning of the Website or any transactions conducted on the Website, or the use of the Website by others.

You may not forge titles or otherwise manipulate identifying information in order to disguise the source of any information or transfer content you send to the Company on, through the Website, or any services offered on or through the Website. You may not impersonate another person, claim to represent another person, or feign any other person or entity.

You may not use the Website or any Content for any purpose that is unlawful or prohibited by the Terms of Use, or to agitate any illegal activities or other activities that infringe on the rights of the Company or others.

The purchase of goods or services is subject to the Terms and Conditions of Sale and other terms and conditions announced by the Company, which shall be deemed to be a part of the Terms of Use. In the event of a conflict between the Terms of Use and the terms announced or applicable to a particular section of the Website or any services offered on or through the Website, your use of that section of the Website or that particular services shall be governed by the latter terms.

The Company's obligations with respect to its products and services are governed by the contracts under which the products and services are provided, and the Website may not change the contents of such contracts.

The Company may change any products or services offered on the Website, or the applicable prices for any such products or services, at any time without further notice. The information on the Website relating to products and services may be out of date, and the Company does not promise to update the information on the Website relating to such products and services.

Certain functions or services available on or through the Website may require you to create an account. You are solely responsible for maintaining the confidentiality of account information (including passwords) held by you, and you are solely responsible for any and all activities that occur under your account as a result of your failure to maintain and keep such information confidential. The Company’s Website and mobile applications may be linked to third-party websites and services that are not under the Company’s control. We are not responsible for the security or privacy of any information collected on the third-party websites or other services. When you access these websites, you do so at your own risk and review the privacy statements applicable to the third-party websites and services you use.

The Company cannot guarantee that the Website or any of the Content, services or functions will be completely error-free, uninterrupted, or that any defects will be corrected, or that specific results will be obtained from your use of the Website. Except as otherwise provided by law, the Company shall not be liable to you for any indirect, consequential, incidental, punitive damages, including lost profits. The Terms of Use do not limit or exclude any liability that the Company may not limit or exclude underapplicable laws.

You agree that if your use of the Website or its related factors causes any third party to make any requests, losses, labilities, claims or expenses (including attorney fees) against the Company, the Company's affiliated companies or authorized dealers, or officers, directors, shareholders, employees, and agents thereof, you will be responsible for all the loss,, and promise to hold such companies and personnel harmless from relevant loss.

You acknowledge and agree that the Company may retain any transmissions or communications exchanged between you and the Company through the Website or any services provided on or through the Website, and may disclose such information as required by applicable law, court order or governmental authorities, or as the Company determines is reasonably necessary to (1) comply with legal process; (2) enforce the Terms of Use; (3) to respond to a request that the information violate the rights of others; or (4) to protect the Company, its authorized dealers, the Company’s employees, users of or visitors to the Website and rights, property or personal safety of the public.

You agree that if the Company determines that you have violated the Terms of Use or any other agreement or policy relating to your use of the Website, the Company may terminate your access to the Website and/or block your future access to the Website without prior notice in our sole discretion.

You agree that the Company may, in our sole discretion and without prior notice, terminate your access to the Website if (including but not limited to): (1) requested by law enforcement or other governmental authorities; (2) upon your request (self-deletion); (3) the Website or the services provided by or through the Website are discontinued or materially modified; or (4) an unforeseen technical problem occurred.

If you violate the Terms of Use and the Company does not take any legal action against you, in addition to any other remedies available to the Company, the Company will have the right to request you to pay, and you agree to pay reasonable attorneys' fees and costs for such legal action. You agree that the Company shall not be liable to you nor to any third party for any termination of access to the Website resulting from a violation of the Terms of Use.

The Terms of Use shall be governed by and construed in accordance with the laws of the Republic of China. Except as otherwise provided by applicable laws, any dispute, controversy, assertion, or disagreement of any kind arising out of or relating to the Terms of Use against the Company, or in connection therewith, shall be submitted to Taiwan Taipei District Court as the first instance.

The Company reserves the right to limit the quantities, functions, products or service projects available to any individual or geographic area at our discretion. If prohibited, any functions, products or services offered on the Website shall be deemed null and void.
